TimberWest Campsite Photo Contest (the “Contest”)

These Contest Rules govern the Contest.  By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to these Contest Rules.

Who sponsors the Contest?

The Contest is sponsored and administered by TimberWest Forest Corp. (“TimberWest”).Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site (each a “Third Party Service”), the Contest is in no way sponsored, endorsed or administered by, or associated with, any Third Party Service; any questions, comments or complaints regarding the Contest should be directed to TimberWest and not to any Third Party Service.

When can I enter the Contest?

You may enter the Contest between 12:01 am PST on July 1, 2017 and 11:59 pm PST on August 21, 2017 (the “Contest Period”).

Who may enter the Contest?

The Contest is open only to residents of Canada (excluding residents of Quebec) who have reached the age of majority in their province or territory of residence as of the date of entry.The following persons are not eligible to enter the Contest: (1) employees, officers, directors, representatives and agents of TimberWest, any of its affiliates and any other companies associated with the Contest; and (2) members of the immediate family (spouse, parent, child, sibling) or household (whether or not related) of any person described in (1) above.

How do I enter the Contest?

No purchase is necessary to enter the Contest.  You may enter the Contest by submitting an original photograph that meets the Photo Requirements (as described below) to TimberWest’s Facebook page or to the specified email address, as described in further detail below.  You must include with your photograph a brief written statement setting out the location of the photograph and the date of the photograph (together with the photograph, the “Submission Material”).TimberWest will not acknowledge receipt of any entries to the Contest.

Entry Method #1: Social media (Facebook) EntryTo enter the Contest, log into your Facebook account, and go to the TimberWest Facebook page: www.facebook.com/TimberWestForestCorp/.  On the TimberWest Facebook page, post during the Contest Period your photograph using the “Photo/Video” option and include the other Submission Material in the text box.  If you submit your entry directly to the TimberWest Facebook page, you will be contacted by a representative of TimberWest through Facebook’s messaging system at the Facebook account used to post the photograph, and asked to provide your name, day and evening telephone numbers, email address and age. If you do not provide this information, your entry will not be eligible.  You agree that you are solely responsible for monitoring such Facebook account for any messages received by TimberWest or its representatives in connection with this Contest.

Entry Method #2: Email EntryTo enter the Contest, send an email to contest@timberwest.com during the Contest Period with the Submission Material along with your name, day and evening telephone numbers, email address and age.

Photo Requirements

Any photograph submitted to the Contest must be a photograph you have taken yourself of a family-friendly subject involving a favourite camping experience or family camping memory (the “Theme”).  Your photograph must not contain any copyright or trademark protected material of any person other than you or TimberWest.If you are selected as a potential winner, you must be able to provide TimberWest with a high-resolution version of the photograph for reproduction purposes.

How many times may I enter the Contest?

There is a limit of two (2) entries (photographs) per person, regardless of the method of entry.  If a Facebook account/email address is shared by two (2) or more persons, a maximum of two (2) entries may be received from the Facebook account/email account.

Can my entry be rejected by TimberWest?

TimberWest reserves the right, in its sole discretion, to reject or refuse your entry if (1) you attempt to enter the Contest in a fashion not authorized by these Contest Rules; (2) your entry contains false or misleading information, or is late, falsified, illegible, damaged or incomplete or otherwise irregular; (3) your entry is submitted using robotic, automated, programmed, or other illicit means; (4) your entry contains, depicts, displays, or involves any of the following: (i) any crude, vulgar, profanity, sexually graphic, offensive, “off-colour”, harassing, threatening, derogatory, demeaning, defamatory, racist, abusive, hateful, violent, obscene, or discriminatory images, depictions, symbols or material; (ii) any image, depiction, symbol, or material relating to drugs, cigarettes, or alcohol; (iii) any illegal statements, material, or content; (iv) any material that condones or incites violence, bullying or other unlawful behaviour; (v) any political content or propaganda; and (vii) any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by TimberWest in its sole discretion; or (5) you or your entry is not in compliance with these Contest Rules.

What are the conditions of entry?
By entering the Contest:(a) you agree to be bound by these Contest Rules and by the decisions of TimberWest, which decisions are final, binding and conclusive;(b) you represent and warrant to TimberWest that:(i) your entry, including any material comprising your entry (e.g., the Submission Material, your name, user name and profile picture) and any other material submitted with your entry (all such material, collectively, your “ Full Entry”) is original to you;(ii) you have all necessary rights in and to your Full Entry, including the consent of any third parties whose personal information is included in your Full Entry; (iii) your Full Entry does not contain, depict, include, discuss or involve any of the following: (i) any crude, vulgar, profanity, sexually graphic, offensive, “off-colour”, harassing, threatening, derogatory, demeaning, defamatory, racist, abusive, hateful, violent, obscene, or discriminatory images, depictions, symbols or material; (ii) any image, depiction, symbol, or material relating to drugs, cigarettes, or alcohol; (iii) any illegal statements, material, or content; (iv) any material that condones or incites violence, bullying or other unlawful behaviour; or (v) any political content or propaganda; and(iv) your Full Entry does not contain copyright or trademark protected material of any person other than you and TimberWest;(c) you understand and agree that your Full Entry will not be returned to you and may be moderated or edited by TimberWest as it deems appropriate prior to publication by TimberWest;(d) you grant to TimberWest and its licensees the irrevocable right to use your Full Entry in any media worldwide for promoting TimberWest’s camping and related access programs (the “Promotional Purposes”), including the right to use, reproduce, modify, adapt, translate, or create derivative works from your Full Entry for such purpose without notification, compensation or additional consideration to you;(e) you waive all claims of moral rights in any use of your Full Entry by TimberWest pursuant to the rights granted in these Contest Rules;(f) you agree that TimberWest shall have the right at any time to require you to provide proof of identity or eligibility to enter the Contest and that your failure to provide any such proof upon request may result in disqualification; and(g) you release and forever discharge TimberWest, its respective parents, affiliates, and subsidiaries, any other companies associated with the Contest, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Service, (collectively, the “Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, resulting in whole or in part, directly or indirectly, from (1) your participation in the Contest, including without limitation taking or attempting to take any photograph, (2) the awarding, receipt, possession, use or misuse of any Prize (defined below), in whole or in part, or any travel or activity related to any Prize, (3) the use of any Full Entry in accordance with the rights granted in these Contest Rules, or (4) any breach of these Contest Rules.

What are the Prizes?

There are two (2) prizes (each, a “Prize”) to be awarded in the Contest, each of which is a fourteen day camping pass for use at any of TimberWest’s eight campsites in B.C., with an approximate retail value of CDN $280 each.In addition to any prize conditions provided elsewhere in these Contest Rules, each Prize awarded in the Contest is subject to the following conditions:(a) TimberWest makes no warranties, express or implied, as to the condition, fitness or merchantability of the Prizes.(b) The Prize must be accepted as awarded and may not be transferred, changed or substituted for another prize, except as expressly provided for in these Contest Rules.(c) TimberWest reserves the right to substitute the Prize, in whole or in part, with a prize or prize component of equal or greater value if the prize or prize component cannot be awarded for any reason.(d) Any unused portion of the Prize, once awarded, will be deemed forfeited.  The Prize will not be replaced if lost, destroyed, mutilated or stolen.

How will the potential winner(s) be selected?

All eligible entries received during the Contest Period will be judged by a panel of judges (the “Panel”) selected by TimberWest based on the following three criteria, each weighted equally (collectively, the “Criteria”):(a) the creativity and originality of the Submission Material;(b) the technical quality of the Submission Material (including exposure, use of colour, clarity and focus);(c) the extent to which the Submission Material reflects the Theme.Within five (5) business days of the end of the Contest Period, the Panel will review all Submission Material from all eligible entries, applying the Criteria, and will select two (2) eligible entries as potential winners.  All decisions of the Panel are final and not subject to appeal.

How can a potential winner become a winner?

To be declared a winner, a potential winner:(a) must correctly answer, unaided, a mathematical skill-testing question to be administered by TimberWest;(b) must be in compliance with these Contest Rules;(c) must sign and return a legal declaration and release (the “Release”), which (among other things): (i) confirms the potential winner’s eligibility for the Contest and compliance with the Contest Rules; (ii) acknowledges acceptance of the Prize as offered; (iii) confirms the grant of rights to TimberWest to use the Full Entry for the Promotional Purposes and as otherwise set out in the Contest Rules; and (iv) releases the Releasees (as defined below) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest related activity or the acceptance, use or misuse of any Prize, and any other documentation as reasonably required;(d) provide a high-resolution version of the selected photograph for reproduction purposes; and(e) provide any requested proof of identification to confirm eligibility or to claim a Prize, or proof that the potential winner is the authorized account holder of any Facebook account or email address associated with the selected entry.If a potential winner does not meet the above conditions, the Prize may be forfeited and TimberWest reserves the right, in its sole discretion, to ask to the Panel to select another eligible entry based on the Criteria as a potential winner.

What are the odds of winning a Prize?

The odds of winning a Prize depend on the number of eligible entries received during the Contest Period and on the application of the Criteria by the Panel.

How do I claim my Prize if I am a winner?

Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated between the winner and TimberWest.Except as otherwise indicated by TimberWest, a winner must personally take delivery of the Prize as instructed within 72 hours of being notified that the winner’s Prize is available or within such other time period as the winner may reasonably be advised by TimberWest.  If instructed in writing by the winner, TimberWest may mail the Prize to the winner’s mailing address in Canada.  If a winner fails to take delivery of the Prize as instructed, the Prize may be deemed forfeited and TimberWest reserves the right, in its sole discretion, to ask to the Panel to select another eligible entry based on the Criteria as a potential winner.

How will my personal information be collected, used and disclosed?

By entering the Contest, you consent to TimberWest’s collection, use and disclosure of your personal information as TimberWest deems necessary for the administration of the Contest as described in these Contest Rules and for the Promotional Purposes, as applicable.  Personal information will be held by TimberWest and be used for, and accessible to employees, contractors, licensees or representatives of TimberWest directly involved in the Contest, for internal analysis, and for the Promotional Purposes, as applicable.  You agree that if you are selected as a winner, TimberWest may use your personal information (including name, address, telephone numbers and/or email addresses) to administer the Contest and deliver the Prize.Personal data submitted online becomes the property of TimberWest.  You may access and obtain a copy of your personal information upon written request to contest@timberwest.com.  For more information, please visit TimberWest’s Privacy Policy online at www.timberwest.com/wp-content/uploads/Privacy-Policy2011.pdf (the “Privacy Policy”). Over the course of participating in the Contest, you may be given the option to receive commercial emails or other communications of a commercial nature (collectively, “Commercial Communications”) from TimberWest.  Should you elect to receive Commercial Communications from TimberWest, your personal information will be used by TimberWest to that end, in accordance with the Privacy Policy.Your personal information may be disclosed to a third party in the following circumstances:(a) in accordance with these Contest Rules, or with your consent, or as otherwise permitted or required by law.(b) if you elect to receive Commercial Communications from a party other than TimberWest, TimberWest will disclose your personal information to that other party for that purpose; and(c) if you have been asked to sign and return a Release or other documentation in accordance with the terms of these Contest Rules, TimberWest may disclose your personal information to any interested party, such as a Releasee.If TimberWest discloses your personal information to a party other than TimberWest, your personal information will be subject to that party’s privacy policy and practices.

How do the Releasees limit their liability?

The Releasees assume no liability for the following:(a) any personal injury, death, damage to or loss or destruction of property as a result of taking or attempting to take any photograph for the purposes of the Contest;(b) stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, jumbled, or garbled entries, transmissions, email, mail, or other communications;(c) any error, omission, interruption, defect or delay in transmission, processing, or communication;(d) failures or malfunctions of, or difficulties with, computer hardware or software, telephones, telephone lines, telephone systems, or network, cable, satellite, server, or website connections;(e) printing, typographical, or other errors appearing within these Contest Rules, in any Contest-related advertisements, or in Contest-related materials;(f) incorrect or inaccurate information, including where caused by website users, tampering, hacking, or by any equipment or programming associated or used in connection with the Contest;(g) injury or damage to any computer or other device resulting from or otherwise related to participation in the Contest, the use of any website, or the downloading or accessing of any materials;(h) anyone being incorrectly or mistakenly identified as a winner or potential winner; or(i) any other errors, problems or difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to the Contest, including those errors, problems or difficulties that may relate to the administration of the Contest, the processing of entries, the advertising of the Contest, the announcement of any Prize or winner, or the cancellation or postponement of any event.

What laws apply to the Contest?

The laws of the province of British Columbia and the federal laws of Canada applicable therein apply to the Contest.You agree that: (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Contest or any Prizes shall be resolved individually, without resort to any form of class action, and exclusively by the courts of British Columbia; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs, but in no event including legal fees, disbursements or court costs; and (3) you waive all rights to claim, punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket costs.TimberWest reserves the right to seek any available legal remedy in connection with any attempt to deliberately undermine the legitimate operation of the Contest.

Can TimberWest cancel or amend the Contest?

TimberWest may cancel, modify, or suspend the Contest or amend these Contest Rules for any reason whatsoever, at TimberWest’s sole discretion, without advance notice.
You may not amend these Contest Rules in any way.

Can TimberWest disqualify or ban someone from a Contest?

TimberWest may disqualify without notice or ban someone from the Contest or any future contest for any other reason, including if TimberWest finds that a person has (i) tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest, (ii) provided TimberWest with false or misleading information, (iii) acted in an disrespectful or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person, or (iv) otherwise violated these Contest Rules.

Who makes decisions about the administration of the Contest?

TimberWest reserves the right to make all decisions relating to the administration of the Contest, including the right to terminate, withdraw or amend the Contest or disqualify any entry for any reason.  All such decisions of TimberWest are final and not subject to appeal.

What happens if these Contest Rules contradict other Contest materials or are found to be unenforceable?

In the event of any discrepancy or inconsistency between these Contest Rules and disclosures or statements made by TimberWest or appearing in other Contest-related materials, these Contest Rules shall govern.If any part of these Contest Rules is legally unenforceable or inapplicable, then that part will be deemed invalid; however, the remainder of these Contest Rules will otherwise continue to be legally binding.

How do I find out who won the Prizes?

To find out the names of the winners, please check the TimberWest Facebook page at www.facebook.com/TimberWestForestCorp/ or send an email to contest@timberwest.com requesting the winners’ names on or before September 30, 2017.
